Naturism in Spain: laws and customs
Updated October 24, 2026

In Spain national law does not ban nudity, and topless is accepted almost everywhere. But municipalities can ban nudity with a bylaw, even on all their beaches.

Among the most relaxed countries in Europe about nudity on the beach and topless: the variable is the municipality.
What the law says
In Spain there is no crime of public nudity between adults. The Criminal Code, in article 185, only punishes "obscene exhibition" in front of minors or people with disabilities, with prison from 6 months to 1 year or a fine (12 to 24 months) (BOE, art. 185). The 2015 public security law adds a minor offence for "acts of obscene exhibition" that are not crimes, with fines of €100 to €600 (BOE, LO 4/2015).
The old crime of "public scandal" was narrowed in 1988 to cases in front of minors, or in front of adults without their consent (BOE, LO 5/1988). Since then, according to the Federación Española de Naturismo, nudity has been legal in any public space (FEN, Marco legal).
But municipalities can ban it. In 2015 the Tribunal Supremo upheld Barcelona's bylaw banning walking around naked in the street: being naked in public, it wrote, is not an expression of ideological freedom, so the municipality can restrict it (Poder Judicial).
Where there is no bylaw, the fine does not stand. Alejandro Colomar had been fined for walking naked through the streets of Aldaia, near Valencia. In 2022 the court cancelled the fines, and in 2023 the High Court of the Valencian Community confirmed it: nudity does not breach the public security law, and in Aldaia no bylaw banned it (Valencia Plaza). Colomar himself, however, had to pay €1,080 for disobedience: he had walked into a police station naked and refused to get dressed when the officers asked him to (elDiario.es).
Where you can be naked
- Traditional nudist beaches: according to the FEN, "authorised nudist beaches" were born when nudity was still a crime; today you cannot authorise what is not banned. In practice some municipalities name them in their bylaws, and the nudist zone is often a stretch of the beach marked by signs. In Las Palmas de Gran Canaria, for example, the new beach bylaw (approved in committee in 2021) bans nudity on urban beaches and provides for signed nudist zones at El Confital, La Gaviota and Bocabarranco (Canarias7).
- Naturist stays: private places where nudity is the rule or is allowed in some areas. You can find them in the list of naturist places in Spain. In residential complexes, however, nudity cannot be imposed on owners: in 2023 the Tribunal Supremo struck down the internal rules of Natura World, in Vera, which prevented non-nudists from using pools and common areas in swimwear (Telecinco/NIUS).
Tolerated beaches and bans
People living in Spain talk about beaches with no signs where "everyone is naked", next to stretches where everyone is in swimwear. Others say that people are only naked on nudist beaches, that it depends on the municipality and that not all police officers know the law (Reddit r/askspain).
The key point is precisely the municipality. Some examples of bans:
- Barcelona bans walking around naked in the street, and also in swimwear away from the beaches and the seafront.
- San Pedro del Pinatar, in the Región de Murcia, in its 2017 beach bylaw declares that there is no naturist beach in the municipality and bans "la desnudez integral", despite decades of nudism. The Defensor del Pueblo had suggested involving naturists and cataloguing the traditional beaches; the municipality refused (Defensor del Pueblo).
- Las Palmas de Gran Canaria bans nudity on urban beaches (see above).
According to the FEN, the municipalities with bylaws against nudity are "muy pocos". Before going to a beach you do not know, though, it is worth checking the municipality's rules.
Topless, towns and saunas
- Topless: no national law bans it and it is normal. In a 2025 YouGov survey, 82–83% of women and men find it acceptable on the beach, among the highest of the six European countries surveyed, and 43% of Spanish women have done it. People living in Spain write that you can do it on any beach and that commenting on the body of a topless woman would be "extremely rude" (Reddit r/spain).
- In town: nudity remains frowned upon. Where there is a bylaw, as in Barcelona, you get a fine; the Colomar case shows that even without a bylaw you can end up in front of a judge.
The local mood
Spain is the most relaxed country in Europe about topless and among the most used to nudity on the beach: 44% of Spaniards have been naked outdoors at least once as adults, behind only the Danes and the Germans (YouGov, 2025). National law does not prohibit nudity.
What makes the difference is the municipality: some ban nudity on urban beaches or across their whole territory. In town, nudity is still frowned upon.
Naturist associations
- Federación Española de Naturismo (FEN): the national federation, a member of INF-FNI, the international federation. Together with the association ADDAN it challenged the Barcelona bylaw in court.
We have not verified whether places require a naturist membership card: it is best to ask beforehand.
LGBTQ+ travellers
No legal risk: same-sex relations have been legal since 1979, and since 2005 same-sex couples have been able to marry and adopt (BOE, Ley 13/2005). There are laws against discrimination and hate crimes (ILGA).
